Interim custody bail granted by Delhi HC to accused in EC bribery case to meet ailing mother in Chennai


The Delhi High Court has provided a two-week Interim custody bail to a charges, arrested in 2017 in a bribery case of the Election Commission (EC) which allegedly involved the leader of Aidmk TTV Dhinakanan and others, to meet his sick mother in Chennai.

The High Court said he did not see reasonable causes or reasonable concerns to reject parole to accuse Sukesh Chandrashekar.

It noted that he was in prison for more than three years and had done to pay all costs, including for trips, lodging and rising police officers who would accompany him to Chennai.

While providing assistance, the High Court said, "It emerged from the medical record of the Petitioner's mother, as well as the written response provided by the doctor / consultant for a query made by the state regarding the medical condition of the mother, that the Petitioner's mother was medically in vulnerable conditions." The bench directed Chandrashekar to deposit the progress of RS Lima Lakh with Delhi police to the police escort fee to travel with the air and-from Chennai with him and also other fees needed.

The court directed the accusers placed in Chennai at the address provided by him and left the place only when he needed to accompany his mother or consult a doctor in connection with his medical condition and also explained that he was not entitled to his presence from every personal guard and would not socialize with guests.

"The Petitioner (Chandrashekar) conducts all necessary permissions from the Government of Tamil Nadu as requested according to the rules and protocols that apply to applicable pandemics, before departure from Delhi.

"The applicant will not contact, or offer persuasion, threats, or promises to the complainant or to each witness prosecution; or indulge in any action or negligence that can reduce the delayed process. After the expiration of a temporary prisoner guarantee period, the applicant must be taken back to prison in Delhi, "Bench said.

Chandrashekar was arrested in 2017 by the police. He was accused of 20 cases and had secured guarantees at 17 of them and were detained in three remaining cases.

The cost sheet was filed by the police before the trial court in the case on July 14, 2017, accused that Dhinakan and Chandrashekar conspired to bribe EC officials to get the 'two leaf' symbols for their party.

The police are also included in the allegations of falsification rulers for cheating purposes, using false documents as genuine, have false documents, intend to use it as a native and criminal conspiracy.

Chandrashekar was arrested for allegedly taking money from Dhinakan to bribe the EC high-ranking official to get a 'two leaf' aiadmk symbol for the Sasicala faction in the election by assembly chair R K Nagu in Tamil Nadu.

Dhinakan, was also picked by the police, arrested on April 25, 2018, after four days questioning for allegedly trying to bribe EC officials for symbols.

EC has freezes the AIDMK symbol after both factions - one led by Aunt Sasikala, Dhinakan and the others by former CM O Panneerselvam - said the claim was topped.
